Proclamation Goods Double Limited Lifetime Warranty

WHAT DOES THIS WARRANTY COVER?

Proclamation Goods, Inc. (the “Company”) warrants that your Proclamation cookware (the “Product”)  will be free from defects in material, construction or workmanship under normal use in accordance with care instructions, ordinary wear and tear excepted. This limited warranty gives you specific legal rights and you may also have other rights, which vary from state to state.

WHO MAY USE THIS WARRANTY?

This warranty is extended to the original purchaser or gift recipient of the Product as well as a subsequent owner of the Product if the Product was purchased directly from the Company or through a Company authorized retailer. To make any warranty claim, the original purchase must be registered in the Company’s database, which (i) occurs automatically in purchases made from Company’s website at www.proclamationgoods.com, or (ii) which is otherwise registered online on the Company’s website at www.proclamationgoods.com/pages/product-registration. Any subsequent owner of the Product making a warranty claim must provide a copy of the original receipt or proof of registration.

WHAT IS THE PERIOD OF COVERAGE?

This Double Lifetime Limited Warranty begins on the date of registration and extends to any  subsequent owner of the Product who can submit the original proof of purchase or registration.

WHAT DOES THIS WARRANTY NOT COVER?

This warranty does not cover:

  • Products originally purchased from unauthorized sellers.
  • Damage arising from thermal shocks, drops, improper use, failure to follow the Product use and care instructions, or any unauthorized modification or repair
  •  Normal product wear and tear, which can include stains, discoloration, or scratches on the inside or outside of the product.
  •  Discoloration, warping, or metal separation due to high heat or prolonged heat exposure when empty
  •  Commercial, professional, or workplace use
  •  Damage caused by use of metal utensils and tools, scouring pads, steel wool, abrasive cleaners, or bleach
  •  Minor imperfections and color variations, which are normal.
  •  Any damage caused by a force majeure, such as a fire, flood, act of war or similar catastrophic events.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

Upon determination that the Product is eligible for Warranty coverage, the Company will either repair or replace the defective Product (or the defective part) free of charge, at the Company’s sole option. If the specific Product is no longer being sold, we may, in our sole discretion, elect to replace the Product with a similar product, or refund the purchase price of such Product. If an eligible Product is returned within thirty days of purchase, the Company  will pay for shipping and handling fees; the customer is responsible for all shipping and handling if returned after 30 days from the date of original purchase..

LIMITATION OF LIABILITY

THE COMPANY, ITS AFFILIATES, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS (COLLECTIVELY “PARTIES”) SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE THE PRODUCTS EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND THE COMPANY IS NOT LIABLE FOR ANY OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THE COMPANY’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. THE COMPANY, ITS AFFILIATES, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS (COLLECTIVELY “PARTIES”) SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE THE PRODUCTS EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

GOVERNING LAW AND DISPUTE RESOLUTION

The terms of this Warranty shall be governed by and construed in accordance with the laws of the State of California U.S.A., as they apply to agreements made and solely performed therein.   Jurisdiction and venue for any and all legal actions regarding the Products or any warranty claim shall be in the state and federal courts of competent jurisdiction located in San Francisco County, California.
